Steps to Take after a Car Crash

The scene after a car accident can be chaotic. If you are not seriously injured, take the following steps for your own protection and to lend credence to your personal injury claim for compensation.

Stop Your Vehicle, Call the Police, and Take Pictures

Under Georgia Code Section 40-6-273, you are required to stop your vehicle, remain at the scene of the crash, and notify the police of any traffic accident resulting in injury, death, or $500 or more in property damage. If you are able, take pictures of where your car came to a rest before moving it off the road. It is in your best interests to have an officer come to the scene to make an official accident report. Do not admit fault for the crash.

Assess Injuries Sustained in the Accident

Assess your own injuries after the crash. If you are hurt, get immediate medical attention. If an occupant of another vehicle appears to be badly injured, call 911 and inform the operator. It is important to be evaluated by a doctor soon after a car accident, even if you believe your injuries are minor or non-existent. Some injuries, such as whiplash, may not be apparent in immediately after a wreck.

Gather Evidence at the Scene

If you are able, take proactive steps to document the crash. Take pictures of the scene, including damage to your vehicle and other vehicles, tire marks on the roadway, and your injuries. It is better to err on the side of too many photos of the scene than too few. This evidence will also help your Gwinnett County car accident lawyer work on your case.

Take Notes and Talk to People

Get insurance, license, registration, and contact information from the other drivers involved in the accident. Talk to any eyewitnesses and get their contact information, as well. Write down what occurred. Reference notes may be considered more credible than memory alone in a car accident case.

Notify Your Insurance Company

Personal auto insurance policies have a notice provision in which policyholders are required to notify the insurance company of a crash within as few as 30 days after the accident. Putting your insurer on notice also makes it possible to file a claim under your uninsured/underinsured motorist coverage in case the at-fault driver does not have enough insurance to cover your damages.
